The council approved a liquor license transfer to Fubol-Landia on Early Street by William Walsh, then heard two hours of spirited testimony about a request from William’s son Billy Walshto transfer a liquor license to 10 DeHart St. for a bowling alley/ bar.

That one will be continued on July 18.

A RESOLUTION APPROVING THE APPLICATION OF UNCLE BAXTER, LLC FOR A PERSON TO PERSON AND PLACE TO PLACE TRANSFER OF LIQUOR LICENSE NUMBER 1424-33-015-011 TO 4 EARLY STREET, MORRISTOWN, NEW JERSEY

WHEREAS, an application has been filed for a Person-to-Person and Place-to-Place Transfer of Plenary Retail Consumption License Number 1424-33-015-011 to Uncle Baxter, LLC and for the premises located at 4 Early Street, Morristown, New Jersey; and

WHEREAS,    the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term; and

WHEREAS,    the Applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33; and

WHEREAS,    the Applicant has disclosed and the issuing authority has reviewed the source of all funds used in the purchase of the license and the licensed business and all additional financing obtained in connection with the licensed business; and

WHEREAS, following the receipt of written objections, pursuant to N.J.A.C. 13:2-2.7, a hearing was held on May 30, 2012 at 7:00 p.m. and continued on June13, 2012 at 6:30 p.m. and all parties were notified of the date, hour and place of the hearing; and

WHEREAS,    during the hearing the Town Council heard testimony from the Applicant, from objectors, and supporters of the Application; and

WHEREAS, the Applicant and the Town have conferred and the Applicant has agreed to the following proposed conditions on the instant license; and

WHEREAS, the Town Council has determined that these conditions are fair, appropriate and reasonable under the circumstances;

NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Town Council of the Town of Morristown being the governing body thereof, does hereby approve, effective July 1, 2012, the Person-to-Person and Place-to-Place transfer of the aforesaid Plenary Retail Consumption License to Uncle Baxter, LLC at the premises located at 4 Early Street, Morristown, New Jersey, and does hereby direct the Town Clerk/A.B.C. Board Secretary to endorse the license certificate to the new ownership as follows: “This license, subject to all its terms and conditions, is hereby transferred to Uncle Baxter, LLC at the premises located at 4 Early Street, Morristown, New Jersey, effective July 1, 2012,” subject to the following conditions:

Applicant agrees to install additional exterior lighting, particularly on the west side of the building where the vacant lot is located;

Applicant agrees to install a video surveillance system covering both the interior and exterior areas of the building;
The Applicant agrees to hire one (1) security officer for every fifty (50) people within the    premises on Thursday, Friday and Saturday nights and any night during which there will      be any special attractions or major sporting events broadcasted or live band and/or D.J. music;

The Applicant agrees to hire one (1) off duty police officer to stand outside of the premises on Thursday, Friday and Saturday between the hours of 1:00 am and 2:30 am and any night during which there will be any special attractions or major sporting events broadcasted or live band and/or D.J. music;

The Applicant shall insure that no patron shall congregate, possess or consume alcoholic beverages, at any time on the premises outside the confines of the building;

The Applicant agrees that all doors shall remain shut at all times, except those doors temporarily opened as permitted for ingress and egress and except as emergencies may otherwise require temporary opening;

The Applicant shall arrange for cleanup of any litter, trash, beer or other alcoholic   beverage containers or debris from the area, including the parking lot utilized by patrons of the premises as well as the nearby streets that are frequented by exiting patrons.  The activities shall be completed by 8:00 am of each following morning.

The Applicant agrees that pursuant to the Morristown Town Code at no time will more than thirty percent (30%) of the floor area of the restaurant be devoted to the
entertainment portion of the business.

The Applicant agrees that patrons shall not be permitted to line up for entry into the establishment on Early Street.

BE IT FURTHER RESOLVED that the conditions of this Resolution are intended to set stipulations on the Applicant’s liquor license.  Nothing herein should be construed to waive the Applicant’s obligations to comply with all other applicable State and Federal laws, rules and regulations and ordinances of the Town of Morristown including noise ordinances, nor to waive the Applicant’s obligations to comply with existing and future land use approvals and requirements as determined by the Morristown Zoning Board of Adjustment, Planning Board and/or decisions of the Superior Court of New Jersey.

  1. There have been no new liquor licenses issued in Morristown since 1947. The number of bars was capped at the 1947 level. Only private clubs, hotels or theatres can obtain a new license.

    Be realistic. That parking lot that abutts your condos will some day be 7-8 stories of garage or more apartments. You can’t stop progress especially when the town zones these areas for these specific things. If you want open space, you probably should move somewhere closer to that. You are a block and a half from the center of down town. If your association really wants this space open, why don’t you and your association purchase it off the builder. Good luck

  3. As Georgetowne condo home owners, we are very concerned with the proposed bar/bowling alley. How many bars can Morristown support? The police can’t keep up with the DUI arrests now. We are not interested in having our property devalued with noise, garbage and bar patrons parking in our lot. When we moved here from the Midwest, we were quite delighted to find this idyllic town built around a green space with historic churches, architecture, etc. We are not interested In Becoming another Newark or Paramus or Jersey Shore town. We pay a great deal in taxes and vote NO for another bar! Brett and Karen Able. Georgetowne condo owners
