It has become a numbers game for Toshiba Foster, and the numbers aren’t looking too good as she returns to Superior Court today, July 29, in hopes of overturning Councilwoman Raline Smith-Reid’s Democratic primary victory in Morristown’s Second Ward.
Toshiba had challenged 55 of Raline’s voters. This week, Toshiba withdrew 18 of those names from her challenge, leaving 37 contested votes.
Raline’s lawyer, Paul Bangiola, has indicated that he will ask that another 20 names be withdrawn.
That would leave only 17 contested votes–not enough to overturn Raline’s 21-vote victory in June.
Attorney Shari Weiner is scheduled to stand in for Toshiba’s ailing lawyer at 11 am before Judge Thomas Weisenbeck.
