A Superior Court judge plans to dismiss a year-old child pornography case involving a Morris County employee if state prosecutors don’t proceed within 30 days, reports the Daily Record.

Anthony P. DeSimone, 74, of Morris Township, was suspended without pay from his job at the Morris County Board of Elections after he was charged last December with endangering the welfare of a child by allegedly possessing and viewing child porn.

Judge Stephen Taylor issued his directive when nobody from the state Attorney General’s office attended a case review hearing this week, the paper reported.

A  spokesman for the Attorney General’s office blamed a personnel change for the situation and told the newspaper that a new attorney would follow up shortly with DeSimone’s defense lawyer.
